: that's right. the u.s. navy quickly assembling what records it has on this man. and telling us he was a navy reservist. just until a few days ago, he separated from the naval service. we don't know when the last time is he showed up. but he has shooting expertise. let's go through it. according to navy records, he has been awarded the rifle marksman ribbon and the pistol expert medal. these are awarded for achieving a certain level of shooting accuracy at various distances. let's be clear. the plan is not a navy commander, he's not a navy s.e.a.l. he held a number of jobs as a reservist in navy security operations. in fact, he went to iraq, we are told, and had a job providing military security on iraqi oil platforms, to have that job, it is most likely we are told he did receive some advanced weapons training. you will remember back in those days, those oil platforms, a lot of concern about small boat attacks, sniper attacks, that sort of thing. so he clearly has a certain level, a worrisome level of weapons expertise. the police know this. they know what they are dealing with. w

't giving up yet. i'm wolf blitzer. you're in "the situation room." cutting our pay. that's how one u.s. officer says u.s. troops view the recommendation for a smaller pay increase in 2014. no one goes into the military to get rich but most servicemen and women need every dollar in their paycheck. so worried that next paycheck may be smaller is not going over well among the troops. our pentagon correspondent barbara starr has the details. she's working the story. barbara, what's going on? >> wolf, in this town, there's nothing that causes more anxiety in budget politics than the concept of cutting the pay for the troops. but that is exactly what is on the table if congress and the president cannot reach an agreement on a spending plan. the troops usually are happy to see defense secretary leon panetta, smiles and handshakes all around. but days before he leaves office, panetta has bad news. he's proposing less money in their paycheck next year. panetta, a savvy washington operative in budget politics, is leaving it to congress to figure out how not to cut pay and keep thousands of defen

in the united states on this? >> there is no official reaction from the u.s. government. of course, the u.s. was expecting this ted stevens morning. was speaking to an official that said the test could come any time. obviously they have been bracing for it. right now a lot of frantic telephone calls going on. not only within the u.s. government but also in south korea. the new secretary of state, john kerry, spoke to the south korean foreign minister just moments ago about the latest nuclear test and now everybody is trying to get their diplomatic ducks in a row. everybody getting on the same page. there will be a security council meeting tomorrow morning, 11:00 eastern time. to discuss the next response and that is what the question is. what will the traffic there? will the chinese sign on to the tough resolution that the united states is looking for? will they set on to tough sanctions. it is unclear at this point what china will agree to and that is the best the u.s. can hope for in terms of getting anything out of the u.n. security council. then i also understand the united states is al

say they do not have the capability to make a bomb. >> well, zoraida, it will be days before the u.s. has a very good handle on the size of the explosion, the size of the payload, but at first glance what u.s. officials are very concerned about are north korea's claims that it testified a miniaturized nuclear weapon. why is that so concerning? that means they're closer to making a missile that they could launch toward the united states. these types of dplier tesnuclea moves them closer to mastering the idea. it was expected, officials tell me, that north korea warned the u.s. and china yesterday that a test was eminent. after the test president obama issued a statement. what he said was north korea's nuclear weapons and ballistic missile programs constitute a threat to u.s. national security and to international peace and security. we will strengthen close coordination with allies and partners and work with our six-party partners,united nations security council and other u.n. member states to pursue this. they will be meeting this morning in an emergency session. my source is telling

, the question we are asking today, when is it legal for the u.s. government to kill its own citizens overseas? talking about americans here. justice department memo made public by nbc spells out the position, by the obama administration, now what it says the memo justifies the targeted killing of an american who is considered a senior operational leader of al qaeda or an associated group, and who poses an imminent threat of violent attack against the united states. want to bring in halle goran any. a controversial issue, under president bush, now president obama. the fact that the government does have the power, and the authority, to kill an american overseas that's considered a threat. and how do they define that? >> that's the question because when you say imminent, it could be imminent in a few hours, in a few weeks, saying you can target a member of al qaeda, senior operational al qaeda leader, or associated forces. how are you defining associated forces? how are you defining the word imminent? how are you defining the word threat? all of these things are things that are open to interpret
